Terms of Use

These terms govern your use of the Kirsten Sander Ltd. website at www.kirstensander.com,
our help desk, and our applications — including the Daily Tilt puzzle game.
By using any of them, you agree to these terms. If you do not agree, please do not use them.

Licence to use our apps

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and
use our apps on devices you own or control, for your own non-commercial use. The apps are
licensed to you, not sold. We keep all rights not expressly granted here.

Acceptable use

You agree not to:

• Modify, reverse-engineer, decompile or create derivative works from our software, except
  to the extent the law expressly permits it;
• Submit falsified solves, automate gameplay, exploit bugs to gain an advantage, or
  otherwise interfere with leaderboards, community votes or other players’ experience;
• Choose a display name that is offensive, impersonates someone else, or infringes
  another party’s rights — we may change or remove such names;
• Attempt to gain unauthorised access to our servers, disrupt our services, or use them
  for anything unlawful.

We may suspend or remove access, scores or display names that breach these rules.

Player identity and progress

Daily Tilt identifies you by a random player ID rather than an account with a password.
We do our best to keep your progress safe, but a player ID that is lost — for example by
uninstalling without a linked sign-in — generally cannot be recovered. On Android you may
optionally link Google Play Games to protect your progress across devices.

Purchases

Some apps offer paid unlocks such as Daily Tilt Plus and consumable undo tokens.

• Payment is processed by Apple or Google, not by us. Your purchase is
  also subject to the App Store or Google Play terms.
• Refunds are handled by the store you bought from, through
  Apple’s Report a Problem or your
  Google Play order history.
  Contact us first if a purchase did not unlock — we can usually fix it directly.
• Consumable items, such as undo tokens, are used up when spent in-game
  and are not restored by “restore purchases”. Non-consumable unlocks can be restored on a
  new device.
• This does not affect your statutory rights as a consumer.

Advertising

The free version of Daily Tilt offers optional rewarded ads that you choose to watch in
exchange for extra attempts. Ads are supplied by Google AdMob and their content is not under
our control. Purchasing Daily Tilt Plus removes advertising.

Availability and changes

We aim to keep our services available but we do not guarantee uninterrupted access. We may
change, suspend or discontinue any feature, level, or product — including online leaderboards
and the daily puzzle service — and we may update these terms. Material changes to these terms
will be published at this address before they take effect.

Our liability

Our services are provided “as is”. To the fullest extent permitted by law, we exclude
implied warranties and are not liable for indirect or consequential loss, loss of progress,
or loss of data.

Nothing in these terms limits or excludes our liability for death or personal
injury caused by our negligence, for fraud, or for anything else that cannot lawfully be
limited. If you are a consumer, you keep all your statutory rights.

Intellectual property

The apps, this website, their code, artwork, puzzle content and branding are owned by
Kirsten Sander Ltd. or our licensors and are protected by copyright and other rights. You may
share screenshots and your daily results freely.

Apps obtained from the Apple App Store

Where you obtained the app from the Apple App Store, the following also applies:

• This agreement is between you and Kirsten Sander Ltd. only, not with Apple.
  We, not Apple, are solely responsible for the app and its content.
• Your licence to use the app is limited to Apple-branded products that you own or control,
  as permitted by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the app.
  All support requests should be sent to
  support@kirstensander.com.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple
  may refund the purchase price. To the maximum extent permitted by law, Apple has no other
  warranty obligation with respect to the app.
• We, not Apple, are responsible for addressing any claims relating to the app, including
  product liability, legal or regulatory compliance, consumer protection claims, and any
  claim that the app infringes a third party’s intellectual property rights.
• You confirm that you are not located in a country subject to a US Government embargo or
  designated as a “terrorist supporting” country, and that you are not listed on any US
  Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce
  them against you.

Governing law

These terms are governed by the laws of The United Kingdom and the courts of the United Kingdom have jurisdiction. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of your home country’s law.
